U.S. Rep. Mark Green (R-TN-07) has sent a letter to the Bureau of Alcohol, Tobacco, Firearms and Explosives expressing what he called “grave concerns” over that agency’s intention to impose regulations on stabilizing braces for firearms.
This, according to a press release that Green’s staff published on his website this week.
According to the website Arsenal Attorneys, this classification “can mean the difference between a firearm equipped with such a brace being classified as a pistol and thus not subject to the National Firearms Act or as a short barrel rifle requiring registration and payment of a $200 tax.”
Green, in a letter Tuesday to acting ATF Director Regina Lombardo “that ATF’s guidance on this action infringes on the 2nd Amendment rights of all Americans.”
“While in the past, ATF has issued classification letters for various braces, this notice appears to rescind those previous letters and evaluate braces on an undefined case-by-case basis. Gun Owners of America has noted ATF states that things like caliber will be an objective factor, but doesn’t tell what calibers. ATF lists weight and length as objective factors, but similarly doesn’t provide any specific weights or lengths. In other words, ATF’s objective factors will be a secret, and will be interpreted entirely subjectively,” Green wrote.
“Additionally, this notice appears to be illegal. ATF is only providing a 14-day comment period on the proposed guidance. My understanding is the Gun Control Act mandates a 90-day comment period. ATF’s notice is a reckless example of bureaucratic overreach at the expense of law-abiding American gun owners. I urge you to rescind this notice, and I respectfully request a formal response by December 31, 2020.”
According to Arsenal Attorneys, violation of the requirements of the National Firearms Act is a felony potentially subjecting the offender to several years in prison and permanent loss of firearms rights.

It’s either legal or it isn’t. You can’t have a change of mind about the interpretation of the law. If’ it’s decided that they are illegal then everyone who every had one and used it is now a felon. You cannot unscrub what the firearm is once you build it into a shortbarrel rifle.
